Tarmac –v- Hughes
The
recent decision of the Agricultural Land Tribunal of Wales in the above
case represents another success for Nigel Davis Solicitors who acted
for the landlords, Tarmac UK Limited, in an application for a Case C
Certificate. The case was most unusual in that the tenant, Mr. Hughes,
proved to be extremely elusive particularly when it came to the service
of papers and the hearing itself which had to take place on no less than
three separate occasions. Mr Hughes’ practice with regard to his
post was to allow this to pile up in an outbuilding which meant that
personal service had to be effected at every stage.
When the hearing finally took place the Tribunal was satisfied that Mr.
Hughes had failed to comply with the rules of good husbandry, which was
evident not only from the visits by the Tribunal members, but also from
the photographic history produced by the landlord. The Certificate was
duly granted. Notice to quit has now been served and the landlord should
obtain vacant possession of this holding in March 2010.
